1. Purpose & Acceptance

1.1 Purpose This Acceptable Use Policy ("AUP") sets out the rules governing your use of FiberPulse's internet services. It ensures compliance with South African law, protects our network integrity, and maintains service quality for all customers. 1.2 Acceptance By contracting with FiberPulse for Services, you agree to be bound by this AUP and all related terms and conditions. 2. Lawful Use

2.1 General Principle FiberPulse Services may only be used for lawful purposes. You may not use our Services to transmit, store, or distribute any content that violates any South African or international law. 2.2 Prohibited Content The following are strictly prohibited: a) Child Sexual Abuse Material (CSAM) - Any content depicting, describing, or involving sexual abuse of minors b) Obscenity & Hate Speech - Pornographic or sexually explicit material - Content promoting racial, gender, religious, or ethnic hatred - Speech designed to incite violence or hatred - Defamatory content c) Abuse & Harassment - Stalking, harassment, or threats of bodily harm - Abuse directed at FiberPulse staff or any third party - Cyberbullying d) Intellectual Property Violations - Copyright-infringing material (pirated software, movies, music) - Trademark violations - Trade secret breaches e) Privacy Violations - Collecting Personal Information of third parties without consent - doxxing or exposing private information f) Fraud & Financial Crimes - Pyramid schemes, phishing, or financial fraud - Impersonating another person or entity - Exchange control violations g) Illegal Goods & Services - Sale or distribution of illegal drugs, weapons, or contraband - Human trafficking or exploitation

3. Network Security

3.1 Prohibited Activities The following activities threaten the security and integrity of FiberPulse's network and are strictly prohibited: a) Unauthorized Access - Attempting to gain unlawful access to any network, system, or account - Bypassing security measures or authentication - "Cracking" or "hacking" attempts b) Spoofing & Forgery - Forging TCP/IP packet headers or email headers - Impersonating another user or entity c) Attacks & Disruption - Denial of Service (DoS/DDoS) attacks - Network flooding or overloading - Scanning or "nuking" other networks d) Malicious Code - Transmitting viruses, trojans, worms, malware, or botnets - Hosting or distributing malicious software - Running compromised services with known vulnerabilities e) Unauthorized Monitoring - Wiretapping or monitoring network traffic without authorization - Packet sniffing on shared networks f) Abuse of Services - Running open SMTP relays - DNS amplification attacks - Cryptocurrency mining on shared resources

4. Service Usage & Business Restrictions

4.1 Service Type FiberPulse provides uncapped, unshaped, and unthrottled internet services. Your connection speed is a best-effort offering and actual speeds may vary based on network conditions. 4.2 Business Use Restriction Residential services are for personal/home use only. The following are prohibited: - Reselling or providing services to third parties - Operating as an Internet Service Provider (WISP) - Hosting public servers (mail, HTTP, FTP, IRC, VPN) - Running commercial services on residential connections - Using the connection to provide internet access to others (shared use)

5. Email & Communications

5.1 Spam Prohibition FiberPulse strictly prohibits unsolicited bulk email (spam). This includes: - Unsolicited commercial email - Chain letters - Harvesting email addresses without consent 5.2 Permitted Email Email is permitted where: - There is a prior relationship with the recipient - The recipient has explicitly consented - The email concerns an existing business relationship 5.3 Mail Server Security Customers operating mail servers must: - Secure servers against public relay - Maintain valid sender authentication (SPF, DKIM, DMARC) - Remove invalid/undeliverable addresses promptly

6. Web Hosting

6.1 Intended Use Hosting services are designed for personal websites and small business use. Excessive resource consumption may result in migration to a higher-tier product. 6.2 Prohibited Hosting Activities - Storing malicious content or malware - Phishing sites or fraudulent activities - Running untested or poorly optimized applications - Mass mailing scripts - TOR exit nodes - Torrent seeding/sharing servers 6.3 Resource Limits - CPU and memory usage must remain within allocated limits - Database queries must be optimized - Backups should not consume excessive disk space

7. Minors & Parental Responsibility

7.1 Minor Protection FiberPulse prohibits the use of its Services to harm minors in any way, including: - Hosting child sexual abuse material - Cyberbullying of minors 7.2 Parental Responsibility Parents/guardians are responsible for: - The online conduct of minors using the account - Controlling minors' access to services - Ensuring lawful use by minors

8. Account Security

8.1 Customer Responsibility You are responsible for: - All activity on your account - Ensuring unauthorized persons do not access your connection - Securing your devices and credentials 8.2 Security Best Practices - Use strong, unique passwords - Enable router firewalls - Keep devices updated - Do not share credentials

9. Reporting Violations

9.1 Report Abuse To report AUP violations, email: abuse@fiberpulse.co.za Include: - Description of the violation - Relevant dates/times - Evidence (logs, screenshots, headers) - Your contact details

10. Enforcement & Consequences

10.1 Investigation Upon receiving a complaint or detecting a violation, FiberPulse may: - Investigate the incident - Collect evidence - Contact the relevant parties 10.2 Actions FiberPulse reserves the right to take the following actions: Minor: Warning, education Moderate: Temporary suspension Severe: Account termination, legal action Critical: Immediate termination, law enforcement referral 10.3 Cost Recovery Violators may be charged for: - Administrative costs - Investigation time - Network impact remediation 10.4 Cooperation FiberPulse may cooperate with: - Law enforcement agencies - Other ISPs - Copyright holders - Affected third parties

11. Amendments

11.1 Right to Amend FiberPulse reserves the right to amend this AUP at any time. Notice of material changes will be posted on our website or emailed to you. 11.2 Continued Use Your continued use of Services after any amendment constitutes acceptance of the updated AUP.

12. ISPA Compliance

12.1 Terms & Conditions Availability FiberPulse makes this Acceptable Use Policy and all applicable terms and conditions available to customers and potential customers prior to the commencement of any contract. All information and terms relevant to the relationship with the customer are included in our service agreements. 12.2 Content Removal FiberPulse reserves the right to remove any content hosted on our network which we consider illegal, or for which we have received a valid take-down notice from a competent authority or rights holder. 12.3 Suspension & Termination FiberPulse reserves the right to suspend or terminate the service of any customer who: - Does not comply with this Acceptable Use Policy - Does not comply with any other contractual obligations 12.4 Appointment of ISPA as Agent FiberPulse formally appoints the Internet Service Providers' Association (ISPA) as its agent for the purposes of receiving take-down notifications in terms of the Electronic Communications and Transactions Act 2002 (ECT Act). 12.5 Website Disclosure FiberPulse's website (www.fiberpulse.co.za) states that ISPA is the nominated agent for receiving notifications of alleged unlawful activities or take-down requests. 12.6 ISPA Contact Information The following contact information for ISPA is made publicly available: Internet Service Providers' Association (ISPA) - Telephone: 010 500 1200 - Email: complaints@ispa.org.za

13. General Provisions
